TrackPro - Terms of Use

1. Acceptance of Terms

By downloading, installing, or using TrackPro ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

2. Description of Service

TrackPro is a time tracking and invoicing application that allows users to:

• Track time spent on projects and tasks
• Manage clients and projects
• Create and send invoices
• Sync data across devices (Premium feature)

The App is provided by Pender Legacy Holdings LLC.

3. Subscription Terms

TrackPro Premium Subscription:

• Subscription Title: TrackPro Premium
• Subscription Length: 1 month (monthly subscription)
• What You Get: Unlimited invoices, cloud sync across all devices, ad-free experience, and secure cloud backup for the duration of your subscription.
• Payment: Payment will be charged to your Apple ID account at confirmation of purchase.
• Automatic Renewal: Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Renewal Charge: Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
• Managing Subscriptions: You can manage and cancel your subscription by going to your Account Settings in the App Store after purchase.
• No Refunds: Any unused portion of a free trial period will be forfeited when you purchase a subscription.

4. User Accounts

You may create an account to enable cloud sync features. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

5. User Data

You retain ownership of all data you create within the App, including:

• Time entries
• Client information
• Project details
• Invoices

We do not claim ownership of your data. You are responsible for maintaining backups of your important data.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App or servers
• Reverse engineer, decompile, or disassemble the App
• Remove any proprietary notices from the App

7. Intellectual Property

The App and its original content, features, and functionality are owned by Pender Legacy Holdings LLC and are protected by international copyright, trademark, and other intellectual property laws.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

We do not warrant that the App will be uninterrupted, secure, or error-free.

9. Limitation of Liability

IN NO EVENT SHALL PENDER LEGACY HOLDINGS LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes by updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the new terms.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions.
